Terms and Conditions – Energy Savvy Families Program

Background
  • The Energy Savvy Family Program (Program) is provided with the support of the State Government of Queensland, Department of Natural Resources Mines and Energy (DNRME). The Program is designed to assist low income households to better manage energy use and improve energy efficiency and is provided through a bundle of solution offerings including:
    • Reduce Your Juice, mobile based digital game, social media and rewards program
    • Installation by Ergon Energy Retail of a smart meter with monthly billing
    • Access to the Ergon Energy Retail HomeSmart Savvy program
    • Access to a local Champion
  • The Consortium has been established to provide the Program. Details of the Consortium members are available by clicking here:
  • Each Participant in the Program will be eligible to receive a range of incentives or Rewards upon completion of various segments of the Program and upon completion of the Program in its entirety.
  • Participation in the Program is voluntary and participants may withdraw at any time without penalty. Your decision to participate or not participate will in no way impact upon your current or future relationships with a member of the Consortium.
Definitions

In these terms and conditions, unless the context otherwise requires:

  • App means the Smartphone app designed for use in the Program.
  • Champion means a ‘social service’ representative from a local organisation under contract from the Queensland Council of Social Service to provide personal support Participants during the Program.
  • Consortium means the team established to provide the Program, which at the time of commencement is CitySmart, the Queensland Government, Ergon Energy Retail, Queensland Council of Social Service and KPMG and includes any other members joining from time to time.
  • Intellectual Property Rights means all present and future rights in relation to all or any patent, copyright, moral right, trademark, invention, business or company trading names, trade secrets, work methods, tacit knowledge, technical know-how, rights in circuit layouts, database rights, design rights, the right to have confidential material kept confidential, information, data, know-how or experience and any application or right to apply for registration of any right, whether registered or not.
  • Participant means a person who has been applied to be and has been accepted as a participant in the Program.
  • Personal Information has the meaning given to that term in the Privacy Act 1988 (Cth).
  • Program means the Energy Savvy Families Program.
  • Region meaning the locations of Cairns, Townsville, Hervey Bay, Rockhampton and Toowoomba.
  • Reward means a good or service, or entitlement to a good or service, obtained by successfully completing a defined part of the Program.
  • Smart Meter means a digital meter installed on a household premises that has the provision to capture and transmit interval electricity usage data
  • Wave means the description for all the activities that occur form start to finish for a participant
  • Website means www.energysavvy.com.au
  • Us, We, Our means the Consortium, except in the HomeSmart Savvy Terms and Conditions.
  • You means a participant or an applicant to be a participant in the Program.
Eligibility
  • To be eligible for the Program a participant must:
    • Be a current residential account holder of Ergon Energy Queensland
    • Have been selected by DNRME and Ergon Energy Retail for participation
    • Not have been selected for, or participated in, phase 1 of the Energy Savvy Families Program
    • Not have any non-residential tariffs at the premises
    • Have tariff configurations at the premises that can be consolidated to a single digital meter.
  • Registration in the Program is limited to one participant per household.
  • The Consortium may accept or reject an applicant at its discretion or may limit the number of participants at any time.
When accessing the Program
  • To participate in the Program, you must have access to a compatible mobile device (such as a Smartphone), internet and network access. You are solely responsible for providing and the cost of the mobile device, computer, software and access.
  • Your right to access and use the Program, Website and App are personal to you and are not transferable to any other person or entity.
  • You are solely responsible for all actions taken using your username, email or password. If at any time you believe your username or password has been compromised, you should immediately contact us via help@energysavvy.com.au and change your password.
Accessing Reduce Your Juice
  • Reduce Your Juice (RYJ) is an education platform that combines a mobile digital game, electricity hints and tips through email and SMS and an online community in Facebook to share information and encourage participation.
  • To participate in the RYJ part of the Program, Participants will be required to download the RYJ App, regularly play interactive games on the App and receive associated program communications via email, SMS, Facebook or push notifications.
Withdrawing from the Program
  • You may withdraw from the Program at any time by sending an email to help@energysavvy.com.au or telephoning CitySmart on 07 3007 7005 and asking to be removed from the Program.
  • If you unsubscribe from the Program or from receiving communications from us or if we are unable to contact you, you will no longer have access to the Program or Rewards and will no longer receive alerts in relation to the Program. A digital meter already installed at your property will remain with the premises even after cancellation. A digital meter requested but awaiting installation will be cancelled where possible.
About the Consortium/Program Partners
  • Department of Natural Resources Mines and Energy.
    • DNMRE is the funder and supporter of the Program.
    • A representative of DNMRE may contact you for feedback, research, media or communication purposes.

  • Ergon Energy Retail
    • You request Ergon Energy Retail to install a digital meter at your premises (address as listed on your current account).
    • You agree to receive communications such as bills, letters and notices from Ergon Energy Retail to your nominated email address.
    • Ergon Energy Retail provides the HomeSmart Savvy application to monitor electricity use. This assists in households making changes to control their electricity costs. A copy of the HomeSmart Savvy terms and conditions is available here.
    • You may not be able to participate in all aspects of the Program or may not be accepted into the Program if:
      • you opt out of having a digital meter installed prior to installation
      • you refuse remote communications on the digital meter at any time during the program
      • your premises are not suitable for the installation of a digital meter;
      • a digital meter is unable to be installed; or
      • you have a digital meter installed already but do not have 3G/4G mobile phone coverage at the premises.
    • Except as specifically provided, Ergon Energy Retail is not liable for the provision of any prizes or benefits under any Competitions or any Rewards or the Program.

  • Queensland Council of Social Service
    • Queensland Council of Social Service has provisioned a local ‘champion’ in each region to support Participants with their participation in the Program. This includes providing education on energy literacy (including how to interpret the digital meters) and energy efficiency.
    • The Champion may contact you via email or phone only.

  • KPMG
    • KPMG is a professional services firm providing research into the quality of the Program and its delivery, including the Participant experience.
    • KPMG may contact you for feedback and research purposes.
Rewards
  • Upon successful completion of key parts of the Program (such as survey completion and RYJ) participants may be eligible to win a Reward.
  • Pre-program Survey Competition – A random draw from the names of all Participants who have completed the sign-up form and pre-program survey will determine winners of an energy efficient power board.

  • Program Completion Competition (Minor) - A random draw from those who completed both pre- and post-surveys and played each game for at least 10 minutes from each Region per Wave will determine winners of a $35 energy related device.
  • Program Completion Competition (Major) - A random draw from those who completed both pre- and post-surveys and played each game for at least 10 minutes from each Region per Wave will determine winners of a $1,500 energy efficient appliance voucher.

  • Energy Pledge Competition - A random draw from those who have achieved their Energy Pledge Target based on their meter data approximately 6 months post program completion will determine the winners of a $500 reward.

  • All Rewards are subject to availability and substitutions may be made.
  • The Consortium makes no warranties or representations, whether express or implied and expressly disclaims any and all liability (including consequential loss or damages) with respect to the value, type, quality, standard, fitness, suitability or delivery of any of the Rewards. Any warranty claims in respect to a Reward must be directed to the manufacturer or service provider in accordance with any warranty information provided with the Reward.
  • The Rewards are offered to Participants for their personal use and are not for resale.
Prohibitions
  • Each Participant agrees that is a condition of their entry into and continued involvement in the Program that they must not:
  • distribute all or any part of the Program or the contents of our Website or App, other than as intended or as agreed by us in writing;
  • do anything which alters the Website or interferes with or affects its working;
  • remove anything from our Website, add anything to it or create a link to or from another website;
  • disrupt or interfere with any other user’s use of the Program;
  • impersonate any person or entity;
  • use the Program, Website or App in any manner or for any reason not expressly permitted by these terms and conditions;
  • access third party submissions or other content on our App or Website, other than as expressly authorised by us;
  • use the Program, App or Website to list, upload, post or transmit any information or material in any manner or for any purpose that is illegal, unlawful, breaches the privacy or intellectual property rights of another person or entity, is offensive, defamatory, deceptive, deceitful, misleading, inaccurate, fraudulent, obscene, indecent, vulgar, harmful, advocating violence, threatening, abusive, harassing, or contrary to any law;
  • use or launch any automated system including, without limitation, any offline readers, spiders or robots that access our Website or App in a way that:
  • send a larger number of request messages to our servers or to other users of our Website or App that can reasonably be produced by a human in the same period using a conventional on-line web browser;
  • send spam to any other user; or
  • annoy or harass any other user; post or transmit or permit the posting or transmission of any material which contains a virus or other harmful data, code or material; collect, or attempt to collect, any Personal Information about any other user; store, download or redistribute content from our Website or App other than as intended or as agreed by CitySmart in writing; circumvent, disable or otherwise interfere with any security-related features of our Website or App or features that prevent, limit or restrict use or copying of any content from our Website or App; attempt to decompile or reverse engineer any part of our Website or App or to obtain unauthorised access to or copy any part of our Website or App or any part of our Website or App.
Links to other websites
  • Our Website or the App may contain links to third party websites. These links are provided as a reference only and not as an endorsement of those websites, their operators, or the goods or services or the content offered or represented through them.
  • These terms and conditions do not apply to third party websites; each of these websites will be subject to their own terms and conditions and privacy policies. You should review the terms and conditions of use and the privacy policy of any third-party website when you access it.
  • If you choose to access a third-party website from our Website or App, you do so at your own risk. The Consortium is not responsible for, has no control over and accepts no liability in respect to the content or operation of third party websites or any of the goods or services offered or represented through them.
Considerations when you participate in on-line forums
  • As part of the Program we may offer chat rooms, discussion boards, online forums and other interactive technologies that allow individual comments and messages to be tied to a user’s name or e-mail address.
  • Any information you post in such forums is public information and the Consortium cannot control what uses third parties may make of any personal or other information you share in such forums.
  • You must exercise caution before disclosing or posting any information, including Personal Information, on on-line forums.
Limitations
  • The Program, Website, App and Rewards are provided on an ‘as is’ and ‘as available’ basis.
  • We do not represent or warrant:
  • that you will have uninterrupted or error-free access to or use of the Program by any method. Access will be interrupted from time to time, for example, because of software or equipment malfunction, for periodic updating of our Website, App or IT systems, for maintenance and repair or for other actions we may deem necessary or desirable or which are beyond our control; that the Website or App or any files available for downloading will be error-free or free from viruses, faults or defects or that any bugs, viruses, Trojans or other corrupting programs will not be transmitted to or through the Website or App; or that the content of the Program is accurate, complete or suitable for any purpose. You must rely upon your own judgement.
Exclusion of liability
  • The Partners make no warranties or representations of any kind, express, statutory or implied as to:
  • the availability of telecommunications services from your provider to our Website or App at any time or from any location;
  • any loss, damage or interference in respect to the telecommunications services;
  • any unauthorised disclosure of information to third parties or any failure to transmit any data, communications through the Website or App.
  • Under no circumstances will the Consortium (or any member of the Consortium) be liable for any:
  • incidental, special, indirect, direct or consequential damages or loss of profits, interruption of business, loss of business opportunity or goodwill, any claims for indirect, special or punitive damages, third party claims or any indirect or consequential losses or related expenses; or
  • loss or damage, including (without limitation) any injury to any person or property, however arising including, but not limited to:
  • the use of the Website, App or Rewards;
  • any technical difficulties or equipment malfunction (whether or not under the Consortium’s control);
  • any variation in a prize or Reward or the value of any prize or Reward;
  • any tax liability incurred by a winner or entrant; or whether or not the Consortium has any notice of the possibility of any loss or damage.
  • Nothing in this agreement is intended or will be construed as excluding or modifying any statutory rights, warranties or conditions which are applicable to this agreement, the Program, App or Software and which by virtue of any legislation (including the Competition and Consumer Act 2010 (Cth)) may not be modified or excluded.
Privacy
Intellectual Property Rights
  • The Consortium reserves all its Intellectual Property Rights. The rights granted under this agreement to access the Program are a licence only. Nothing contained in this agreement or otherwise grants to a participant any rights of ownership in all or any part of the Program.
  • You acknowledge that the Program is the subject of copyright and other Intellectual Property Rights, laws and treaties. You must not at any time (either before or after termination of this agreement) do any act or permit the doing of any act which infringes that copyright and the other Intellectual Property Rights.
  • You acknowledge and agree that any suggestions for improvements, enhancements and other changes to the Program and any material provided to the Consortium by you will belong to the Consortium (or its relevant member, as applicable) and may be used by the Consortium in whole or in part without any payment or other compensation to you or anyone else.
General
  • If a provision of this document is illegal or unenforceable in any relevant jurisdiction, it may be severed for the purposes of that jurisdiction without affecting the enforceability of the other provisions of this document unless severing the provision materially alters the:
  • scope and nature of this document; or the relative commercial or financial positions of the parties; or would be contrary to public policy.
  • This agreement, the Privacy Policy and the Prize Terms and Conditions (Terms) constitute the entire agreement between the parties about its subject matter and supersedes all prior contracts, arrangements and understandings in relation to that subject matter. The Consortium may alter the Terms by posting the amendment to the terms on the Website.
  • In the Terms, unless the context otherwise requires a reference to:
  • the singular includes the plural and the plural includes the singular; a recital, clause, schedule or annexure is a reference to a clause of or recital, schedule or annexure to this document and references to this document include any recital, schedule or annexure; any contract (including this document) or other instrument includes any variation or replacement of it and as it may be assigned or novated; a statute, ordinance, code or other law includes subordinate legislation (including regulations) and other instruments under it and consolidations, amendments, re-enactments or replacements of any of them; a person or entity includes an individual, a firm, a body corporate, a trust, an unincorporated association or an authority; a person includes their legal personal representatives (including executors), administrators, successors, substitutes (including by way of novation) and permitted assigns; a group of persons is a reference to any two or more of them taken together and to each of them individually; money (including ‘$’, ‘AUD’ or ‘dollars’) is to Australian currency; the meaning of any general language is not restricted by any accompanying example and the words ‘includes’, ‘including’, ‘such as’, ‘for example’ or similar words are not words of limitation; the words ‘costs’ and ‘expenses’ include reasonable charges, expenses and legal costs on a full indemnity basis; headings and the table of contents are for convenience only and do not form part of this document or affect its interpretation; a provision of this document must not be construed to the disadvantage of a party merely because that party was responsible for the preparation of the document or the inclusion of the provision in the document.
Accepting Terms and Conditions and authorising release of information to us
  • By selecting ‘I Accept’ on our Website, you:
  • unconditionally agree to and accept these Terms and Conditions; represent and warrant to us that you have any and all necessary permission from other members of your residential property to provide details of your electricity account;

If you do not accept all the Terms and Conditions or do not authorise information being released to us under section 51, do not select ‘I Accept’. However, you will not be able to register, use or access the Program or Rewards.

Terms and Conditions for HomeSmart Savvy

HomeSmart Savvy

This agreement is in addition to and does not alter your existing Standard Retail Contract with Ergon Energy Queensland or the tariffs supplied under that contract.

Eligibility criteria for participation
  • The HomeSmart Savvy Service is made available to you on the condition that:
  • a digital meter is installed at your premises and you have 3G/4G mobile phone network coverage at this premises, and
  • you are the account holder for the premises.
Suitability of premises
  • After we receive your HomeSmart Savvy Service registration form , we will assess your application. If we determine (in our absolute discretion) that your premises are suitable for the HomeSmart Service, we will provide the service to you.
  • If we determine that your premises are not suitable for the HomeSmart Savvy Service, we will tell you so in writing using the contact details you have given us.
Length of this agreement
  • Your agreement will start on the date that we commission your HomeSmart Savvy Service
  • There is no additional fee for the HomeSmart Savvy Service.
  • We may offer you the opportunity to continue to use the HomeSmart Savvy Service on terms that we advise.
  • We may end this agreement and cease supplying the HomeSmart Savvy Service by delivering written notice to you using the contact details you have given us.  The agreement will then end from the date that we advise you in the notice.
  • You may cancel this agreement at any time by contacting us on the advertised telephone number, email address or mailing address which can be found here. The agreement will then end from the date that you advise us.
  • Your Agreement will also end if:
  • you cease to be the account holder for the premises; or
  • you enter into a new agreement for additional HomeSmart Savvy Services.
Your obligations
  • You must tell us immediately if:
  • you cease to be the account holder for the premises; or
  • your contact details change.
Data collection and Survey
  • By signing this Agreement, you consent to Ergon Energy Queensland contacting you to discuss or to conduct a survey to assess your experience with your HomeSmart Savvy Service.
  • After this agreement ends, you agree, if we ask, to complete a survey about your experience with HomeSmart Savvy. Ergon Energy Queensland will give appropriate notification of any contact regarding surveying your experience and arrange to schedule the discussion at a time convenient to you.
Our liability
  • To the extent permitted by law, if a provision of the Competition and Consumer Act 2010 (Cth) or any other statute applies to the goods or services provided by us under this agreement, our liability is limited, at our option, to:
  • in the case of the supply of goods, any one or more of the following:
  • replacement of the goods or the supply of equivalent goods;
  • repair of the goods;
  • payment of the cost of replacing or removing the goods or of acquiring equivalent goods; or
  • payment of the cost of having the goods repaired; or
  • in the case of the supply of services:
  • supplying of the services again; or
  • payment of the cost of having the services supplied again.
  • Despite any other provision in this agreement, we are not liable to you (whether under contract, in tort, in equity, under statute or otherwise) for any loss of profit, loss of revenue, loss of use, loss of contract, loss of data, loss of production, loss of opportunity, loss of goodwill or any other indirect, incidental, special or consequential loss, damage or cost howsoever caused.
  • You acknowledge that Ergon Energy Queensland does not warrant that the HomeSmart Savvy Service will be uninterrupted, timely, secure, error-free or free from viruses or other malicious software, and no information or advice obtained by you from Ergon Energy or through the HomeSmart Savvy Service shall create any warranty not expressly stated in this agreement.
Demographic data
  • The collection of demographic data is optional. If you volunteer this information we will use it to evaluate how different types of customers respond to the HomeSmart Savvy Service. We will also analyse demographic and electricity usage data to assist with our understanding of energy usage.
Privacy notice
  • We are collecting your personal information for the purpose of enabling you to receive the HomeSmart Savvy Service. If you do not provide all the required information you may not be able to access the HomeSmart Savvy Service.
  • Your personal information will not be disclosed to any other third parties, other than those listed in the paragraph below, without your consent unless authorised or required by law.
  • If you wish to apply for access to your personal information or make a privacy complaint, you may contact the Privacy Officer on 1300 885 034. If you have provided personal information of another individual (such as an authorised representative), please ensure that you advise the person about this privacy statement.
Consent to provide personal information to affiliated organisations
  • You consent for us to disclose your name, address, detailed electricity data, national meter identifier, contact details and any demographic data collected in the process of registering for or using the HomeSmart Savvy Service to our affiliated organisations for the purpose of service delivery, analysis, reporting, marketing and communications associated with the provision of the HomeSmart Savvy Service. Affiliated organisations include the project's software and services provider, energyOS, the mail service provider, Contact Point IT Services Pty Ltd and their analytics service providers and any other organisations commissioned to assist in providing the HomeSmart Savvy Service. The affiliated organisations will only be permitted to use this information for the purposes of this agreement. In addition, we may use and disclose personal information as set out in its Privacy Policy (at https://www.ergon.com.au/about-us/help-and/support/privacy-policy).
  • You permit us to provide your email address to energyOS for the purpose of sending you information concerning your HomeSmart service. You understand that any information provided to energyOS may be stored or accessed outside Australia, including the USA and Canada.  You also understand that the information provided to energyOS is subject to USA and Canadian Privacy Laws.
Definitions
  • In this agreement:
  • Commissioning Date has the meaning set out in paragraph 4.
  • energyOS means Energy OS Pty Ltd, its employees, contractors, servants or agents.
  • Ergon Energy, we, us, our means Ergon Energy Queensland Pty Ltd, its related entities, its employees, contractors, servants or agents.
  • HomeSmart Savvy Service means the information you receive on your energy usage, the enablement of set and forget programs, alerts and alarms and reports that you receive as part of using the service.
  • Standard Retail Contract (SRC) is for small residential and business customers, usually one who consumes less than 100 megawatt hours of electricity per annum. The SRC applies if you have applied to Ergon Energy for customer retail services and we provide you with customer retail services, or your premises are connected to a supply network and you have not applied for customer retail services. Furthermore, the SRC applies without the need for Ergon Energy or the customer to sign a document containing the terms and conditions.

Pre-Program Survey Competition Terms and Conditions

  • The promoter is: Brisbane Green Heart CitySmart Pty Ltd ACN 099 480 010 (CitySmart), the organiser of the Energy Savvy Families program, whose registered office is at Level 8, 307 Queen St. Brisbane QLD 4000.
  • There is no entry fee and no purchase necessary to enter this competition. To be eligible to win the prize, entrants must:
    • be a registered participant of the Energy Savvy Families Program
    • have completed the Reduce Your Juice Start of Program Survey
  • Route to entry for the competition is via an email invitation to the Reduce Your Juice pre-program survey.
  • Opening date for entry is Monday 8 October 2018, and closing date for entry is 11:59pm AEST, Friday 19 October 2018. After this date no further entries to the competition will be permitted.
  • No responsibility can be accepted for entries not received for whatever reason.
  • The prize for the competition is one (1) of four hundred (400) energy efficient power boards.
  • The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
  • The promoter is not responsible for inaccurate prize details supplied by any third party connected with this competition.
  • No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
  • Winners will be chosen before Friday 26 October 2018 at random by software provided by Randomizer.com.
  • The winners will be notified by email within 1 week of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
  • The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
  • By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
  • The winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current Australian data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

Game 1 Competition Terms and Conditions

  • The promoter is: Brisbane Green Heart CitySmart Pty Ltd ACN 099 480 010 (CitySmart), the organiser of the Energy Savvy Families program, whose registered office is at Level 8, 307 Queen St. Brisbane QLD 4000.
  • There is no entry fee and no purchase necessary to enter this competition. To be eligible to win the prize, entrants must:
    • be a registered participant of the Energy Savvy Families Program
    • have played the “Power Raid” game in the Reduce Your Juice app and be the top scoring participant in your region (Cairns, Hervey Bay, Rockhampton, Toowoomba, Townsville.
  • Route to entry for the competition is via the Reduce Your Juice mobile app that can be downloaded from Google Play or the App Store.
  • Opening date for entry is Monday 22 October 2018, and closing date for entry is 11:59pm AEST, Sunday 4 November 2018. After this date no further entries to the competition will be permitted.
  • No responsibility can be accepted for entries not received for whatever reason.
  • The prize for the competition is one (1) of five (5) energy related devices valued at up to $40 AUD.
  • The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
  • The promoter is not responsible for inaccurate prize details supplied by any third party connected with this competition.
  • No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
  • Winners will be chosen before Friday 9 November 2018 by the highest scoring participant as recorded by the Reduce Your Juice mobile app analytics.
